1. Service Provider

MemoryFrame is operated by SIMONCINI DIEGO (hereinafter 'Provider', 'we', 'us'). By using this service, you agree to these Terms of Service.

2. Service Description

MemoryFrame is a free AI-powered tool that generates family portraits from uploaded photos. The service uses OpenAI's image generation technology via API calls. We do not store any photos or user data - all processing is done in real-time through API calls.

3. Free Service & Voluntary Tips

The service is provided completely free of charge. Users may optionally leave a tip to support the ongoing costs of maintaining the service (API costs, hosting, development). Tips are entirely voluntary, non-refundable, and do not provide any additional features or guarantees.

4. Acceptable Use

You agree to: (a) Only upload photos you have the right to use; (b) Not upload illegal, harmful, or offensive content; (c) Not use the service to create deepfakes or misleading content; (d) Not attempt to circumvent rate limits or abuse the service; (e) Comply with all applicable laws and regulations.

5. Photos of Minors

You may only upload photos of minors if you are their parent or legal guardian, or have explicit written consent from their parent or legal guardian. You assume full responsibility for compliance with this requirement.

6. Intellectual Property

You retain all rights to the photos you upload. The generated portraits are yours to use for personal or commercial purposes without restriction. The MemoryFrame name, logo, and website design remain the property of the Provider.

7. No Data Storage

We explicitly do not store, retain, or archive any photos you upload. Photos are processed via real-time API calls and immediately discarded. We have no ability to recover, view, or access your photos after processing.

8. Service Limitations

We impose rate limits (5 generations per hour) to prevent abuse and ensure fair access. We reserve the right to modify, suspend, or terminate the service at any time without notice. Service availability is not guaranteed.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee: (a) Uninterrupted or error-free operation; (b) Specific quality or accuracy of generated images; (c) Availability at any particular time; (d) Results meeting your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless the Provider from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Continued use of the service constitutes acceptance of modified Terms.
